NORTH CAROLINA DOG BITE LAWS 

Every state approaches the legal aspect of dog bites slightly differently. 

North Carolina is one of the states that follows a “one-bite rule.” Under this rule, dog owners may not be liable the first time their dog bites someone or causes an injury. This law protects dog owners whose canines have shown no prior malice or tendency to bite. 

However, there are some exceptions to the one-bite rule. A dog owner may be liable for the first bite if their dog meets the definition of a “dangerous dog.” North Carolina statute 67-4.1 defines a dangerous dog as one that has done any of the following:

  • Seriously injured or killed someone
  • Viciously approached someone while not on the owner’s property, signifying an attack
  • Bitten someone, causing a disfiguring laceration or breaking a bone that led to hospitalization or the need for cosmetic surgery
  • Severely injured or killed a domestic animal or livestock while not on the owner’s property 

A dog owner may also be liable if their dog is a breed with a reputation for being dangerous, such as a pit bull or rottweiler. 

Dog bites needn’t happen on the owner’s property for the owner to be liable. They can happen anywhere: in a public place, at the dog park, or even in your home.
